These Terms and Conditions set out the basis on which Rubbish Removal Earls Court provides rubbish removal and waste collection services to domestic and commercial customers. By making a booking, confirming an estimate, or allowing our team to carry out any work, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any rubbish removal, waste clearance, or related service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Client means the individual, business, or organisation requesting the service.

Company means Rubbish Removal Earls Court, the service provider of rubbish removal and waste collection services.

Services means any rubbish removal, waste collection, clearance, loading, transportation, or related services provided by the Company to the Client.

Waste means any materials, goods, household items, commercial waste, green waste, construction debris, or other items to be removed by the Company, excluding any prohibited or hazardous materials as defined by law.

Booking means a confirmed request by the Client for the Company to provide Services on a specified date and time, whether made by phone, email, online form, or other communication method accepted by the Company.

2. Scope of Services

The Company provides rubbish removal and waste collection services within its operating area, which includes Earls Court and surrounding locations. The precise nature of the Services will be as agreed at the time of Booking. This may include but is not limited to household rubbish removal, office clearance, garden waste collection, bulky waste removal, and general waste clearance.

The Company reserves the right to decline any job which, in its reasonable opinion, is unsafe, unlawful, impractical, or involves prohibited or hazardous materials that it is not licensed or insured to handle.

3. Booking Process

3.1 Booking a service

The Client may request a Booking by contacting the Company via telephone, email, or online enquiry form. The Client will be asked to provide details of the Waste to be collected, the location of the property, access information, and the preferred date and time for the service.

3.2 Estimates and quotations

The Company may provide an estimate based on the description of the Waste given by the Client. Any estimate is non-binding and subject to inspection of the Waste on arrival. If, upon arrival, the volume, weight, type, or location of the Waste differs from the information provided, the Company may adjust the price accordingly. In such cases, the Client will be informed of the revised price before the work is carried out.

3.3 Confirmation of booking

A Booking is considered confirmed once the Company has accepted the Client's request and provided confirmation via phone, email, or other written communication. The Company may, at its discretion, require a deposit or pre-authorisation of payment to secure the Booking.

3.4 Access and parking

The Client is responsible for ensuring that the Company has suitable access to the property and a safe place to park the vehicle. Any parking charges, permits, or penalties arising from providing the Services, where not caused by the negligence of the Company, will be payable by the Client.

4. Client Obligations

The Client agrees to:

Provide accurate information about the Waste, including type, volume, and any special handling requirements.

Ensure that the Waste is accessible at the agreed time and location, and that the property is safe for the Company’s staff to enter and work in.

Comply with any reasonable instructions given by the Company’s staff to ensure safe and efficient provision of the Services.

Obtain any permissions, authorisations, or consents required for the Company to access the premises or remove the Waste, such as permission from a landlord, managing agent, or other relevant party.

5. Waste Regulations and Prohibited Items

The Company operates in accordance with applicable UK waste management legislation and regulations. All Waste collected will be transported and disposed of at licensed facilities in a lawful and responsible manner.

The Company will not collect or handle certain materials, including but not limited to:

Asbestos and asbestos-containing materials.

Clinical or medical waste, including sharps.

Explosives, firearms, ammunition, or weapons.

Chemicals, solvents, oils, and other hazardous substances not permitted under the Company’s licences.

Gas bottles, fuel tanks, or other pressurised containers, unless expressly agreed.

Any other material which the Company reasonably considers to be unsafe, illegal, or beyond its authorised scope of work.

If prohibited items are discovered during the Service, the Company may refuse to handle them and may adjust the price to reflect any additional time or arrangements needed, or may cancel the Service where necessary.

6. Pricing and Payment Terms

6.1 Pricing basis

Prices are generally based on the volume, weight, and nature of the Waste, as well as labour, access conditions, and any disposal charges. The Company will explain the pricing method to the Client at the time of Booking or upon arrival.

6.2 Payment methods

Payment is due in full upon completion of the Service, unless otherwise agreed in writing in advance. The Company accepts commonly used payment methods such as debit card, credit card, bank transfer, or cash, subject to availability and any applicable conditions.

For some Bookings, the Company may require full or partial payment in advance, or a card pre-authorisation, particularly for large or commercial clearances.

6.3 Late payment

If payment is not made when due, the Company reserves the right to charge interest on the overdue amount at a reasonable rate and to recover any reasonable costs incurred in pursuing payment. The Company may also suspend further Services to the Client until all outstanding amounts are settled.

7. Cancellations and Amendments

7.1 Client cancellations

The Client may cancel or reschedule a Booking by giving reasonable notice to the Company. Where the Client cancels:

If more than 24 hours’ notice is given prior to the scheduled arrival time, the Company will normally cancel the Booking without charge.

If less than 24 hours’ notice is given, the Company may charge a cancellation fee to cover administrative costs, lost time, and any expenses incurred.

In the event of repeated cancellations or last-minute changes, the Company may require a non-refundable deposit for future Bookings.

7.2 Company cancellations

The Company reserves the right to cancel or reschedule a Booking due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, severe weather, staff illness, traffic delays, or safety concerns. In such cases, the Company will notify the Client as soon as reasonably practicable and offer an alternative time or date. The Company will not be liable for any loss or inconvenience caused by such cancellations, other than refunding any advance payments made for the affected Service.

7.3 Waiting time and access failures

If, on arrival, the Company is unable to gain access to the property or the Waste is not ready for collection, the Company may charge a waiting time fee or a call-out fee. If access is not possible within a reasonable period, the Company may treat the Booking as cancelled by the Client and apply a cancellation charge.

8. Service Delivery and Performance

The Company will carry out the Services with reasonable care and skill, using appropriately trained staff and suitable equipment. While the Company will make reasonable efforts to arrive within the agreed time window, all arrival times are estimates and are not guaranteed. The Company accepts no liability for delays arising from traffic, adverse weather, or other factors outside its control, provided it makes reasonable efforts to keep the Client informed.

At the end of the Service, the Client will be given an opportunity to inspect the area from which the Waste has been removed. By allowing the Company to leave the site, the Client is deemed to have accepted that the Service has been completed to a satisfactory standard, unless a specific issue is raised at that time.

9. Liability and Limitations

9.1 General liability

The Company will be liable for any direct loss or damage suffered by the Client that is caused by the Company’s negligence or breach of these Terms and Conditions, subject to the limitations set out in this section. The Company will not be liable for any indirect or consequential loss, loss of profits, loss of business, or loss of opportunity.

9.2 Damage to property

The Company will take reasonable care while carrying out the Services to avoid damage to property. The Client should advise the Company of any particularly fragile or high-value items or surfaces that may be affected by the Service. Where damage occurs that is directly and solely caused by the negligence of the Company or its staff, the Company may, at its option, repair the damage, pay the reasonable cost of repair, or provide a fair compensation.

The Company will not be liable for:

Any pre-existing damage, defects, or wear and tear.

Damage resulting from weak or defective structures, surfaces, or access ways.

Damage arising from the Company following the Client’s instructions where those instructions were improper or unsafe.

9.3 Exclusions and limitations

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by its negligence, for fraud, or for any other matter where it would be unlawful to limit or exclude liability.

Subject to the above, the Company’s total liability to the Client in respect of any single event or series of connected events shall not exceed the total price paid or payable by the Client for the Service giving rise to the claim.

10. Insurance

The Company maintains appropriate public liability insurance and, where applicable, employers’ liability insurance to cover its operations. Details of insurance cover can be provided upon reasonable request. The Client is responsible for ensuring that adequate insurance is in place for their own property and belongings.

11. Complaints and Disputes

If the Client is dissatisfied with any aspect of the Service, they should notify the Company as soon as possible, ideally within 48 hours of completion of the work. The Company will investigate the matter and seek to resolve the issue promptly and fairly. The Client agrees to give the Company a reasonable opportunity to inspect and, where appropriate, remedy any alleged defect before seeking any alternative remedy.

Any dispute arising out of or in connection with these Terms and Conditions that cannot be resolved by negotiation may be referred to mediation or other alternative dispute resolution procedures if both parties agree. This does not affect either party’s right to bring legal proceedings.

12. Data Protection and Privacy

The Company will collect and use personal data provided by the Client for the purpose of arranging and delivering the Services, processing payments, and managing the Client relationship. The Company will handle such data in accordance with applicable data protection laws and will take reasonable steps to keep personal information secure. The Client’s details will not be sold to third parties, and will only be shared where necessary to perform the Services or where required by law.

13. Amendments to These Terms

The Company may update or amend these Terms and Conditions from time to time to reflect changes in the law, regulatory requirements, or business practices. The current version will apply to any new Booking. Where practical, the Company will make the latest version available to Clients upon request. Continued use of the Services after any changes take effect will constitute acceptance of the updated Terms and Conditions.

14. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.

By placing a Booking with Rubbish Removal Earls Court, the Client confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
